As taxpayers, we all look for ways to save on our IRS tax burden through investments, rebates, and concessions. Despite all such measures, as law-abiding citizens, we need to pay what’s due. The issue arises when the figure you have arrived at doesn’t match the claim of the IRS. That’s when the IRS Office of Appeals steps in. Contrary to common misconception, getting a discrepancy resolved through the IRS Office of Appeals isn’t a tedious legal rigmarole. The Office of Appeals is an independent body that helps taxpayers resolve any unfair seizure of assets or any tax disputes fairly without litigation. Read on to find out all you need to know about when and how to approach the IRS Office of Appeals and what information to have handy.

Approaching the IRS Office of Appeals

When presenting a case at the IRS Office of Appeals, it is important to have an experienced IRS lawyer on your side who can represent you and negotiate with the Internal Revenue Service. Trust The Law Offices of Nick Nemeth to be your apt representatives and counsels before the authorities.

When to Contact?

Wondering when you’re eligible to make an appeal at the IRS? Here are some of the scenarios:

  • You receive a letter from the IRS regarding your right to appeal
  • You do not agree with the judgment or decision of the IRS and wish to make an appeal
  • You are not signing an agreement form that has been sent to you by the IRS
  • You are seeing an IRS Tax Debt Relief

If you have a reason to believe there has been a misrepresentation or incorrect collection/decision on part of the IRS, you may consider going for an appeal.

Preparing a Request

Having a legal representative on your side to appropriately communicate your concern to the IRS address is just half the job done. A formal written protest to request a conference with the appeals can ensure you are on the way to having the appeal settled without litigation.

Appeal Settlements

If your appeal is authentic, you can expect an appeal settlement to be set up by correspondence or telephone according to the IRS appeals settlement guidelines. This is done to avoid any time or expense by the court for the trial for any IRS tax debt or other subjects of dispute.

Once your date is set, here are a few things you will have to get in order. First up, state the issue of disagreement and understand the facts and law involved in the case in question. Strengthen your case by providing the necessary documentation and listen to the explanation from the IRS. These simple steps go a long way in having you deliver a speedy and fair dialogue.

The settlement period for any appeal depends on the nature and circumstances of the case. Having a representative on your side can help associate nuances in the case with the applicable laws and legalities that support it. The Law Offices of Nick Nemeth hold significant experience in dealing with IRS tax appeal cases and would be happy to be of assistance to you.

I would like to thank Mr. Nick and his staff for the superb help that I received from them. My IRS problem was resolved quickly and efficiently. It took 2 visits to convince me that I was over my head. I thought that I could call the IRS, appeal my tax notices and settle on a payment plan on my own. After many phone calls to the IRS, waiting sometimes more than 4 hours with no resolution to speak of, it proved to be extremely difficult and stressful. Revisiting Mr. Nick was a huge wake up call. My account was reviewed, and a payment plan was established with the IRS within a week. I will be forever grateful to the staff who worked on my case and especially to Lorna who listened to me vent while going through this painful process.

I cannot say enough good things about Nick and his team. When I first met with Nick he was up front, honest, friendly and efficient. When I worked with one of his attorneys, Eric B, I was just as pleased. All of the staff there are nice and very helpful. I wish I hadn't waited so long to get help with my issue. Over 6yrs I tried getting through and getting anywhere with the IRS and hardly made any progress. I know this may not be the case for all, and even I thought it would take longer than it did, but 3mos and they had my situation straightened out. I still can't believe it. Thank you thank you THANK YOU for all that you did for me. This is a huge burden gone out of my life now thanks to you. If anyone needs help out there, I know you may not want to shell out more money to get their help but it may just save you in the long run.

During a time in which competent, professional service at a fair price seems to have disappeared, Mr. Nemeth and his team are a refreshing breath of fresh air. From my first phone call to the final settlement of our case with a non-responsive IRS, they under-promised, over-delivered and were in constant courteous contact to make sure we knew exactly what was happening and where we stood.I hope to never need their services again, but, should I receive another friendly letter from the IRS...I know who to call!
